James McManus launches legal action against the Knights over concussions

How is he able to sues the knights?

Surely its the nrl that is the govening body that has a case to answer?

P.S headgear is widely available at many sporting goods stores.

The club and the league will have liability insurance.
This is what it's for.
Doctors get sued all the time, and part of their cost of doing business is liability insurance - which costs about 80k a year for an average GP and hundreds of thousands for some specialists.

If he wins the case it won't hurt the Knights balance sheet in the short term, but all clubs and the NRL will have to pay higher premiums, and they will have to upgrade their practices - probably change rules to get concussed players off the field.

Maybe if he didn't lead with his head things might have been different. Loved the bloke's effort for us but how he went into tackles with and without the ball the end result was inevitable.

Brown left Lamb out there clearly wounded last year so 20 years down the track when he can't lift his arm it'll be lawyers at 10 paces.

Where did the club instruct him not to wear any head gear?

In fact I am sure any gear the players want would be made available to them.

This is a nothing law suit and deserves to be thrown out of court.

For this case to succeed you would think negligence on Newcastle's part would have to be shown. I just can't see it.

Club Statement: James McManus

Sun 26th February, 09:30AM

The Newcastle Knights are aware of a Statement of Claim made by former player James McManus.

McManus medically retired from the NRL in 2016.

The Club is working through the matter in conjunction with the NRL.

As this is a legal matter, the Club is unable to make further comment.

The Club will however provide any updates at an appropriate time.

Keeping players on the field after a concussion is negligent, which used to be common place. There will be a lot more players suing the league/clubs after this, just like the NFL

Cut it out Matty!

In this day and age it is always everyone else's fault, never my own. And if it is everyone else's fault they can pay.

Concussion is a tough one, isn't it caused by bruising on he brain caused by collision?

This is a collision sport and each incident affects the individual to varying degrees, at least in this day and age there are safe guards in place in bygone days there was nothing.

How does one protect against it ? short of MRI for everyone after each game

Check out some of the whiplash though slots, not to mention head smacking into the ground cant be helpful after a big shot.

Can't eliminate it all together but as others have stated at least they are trying to protect players now.

In my experience if you are suffering concussion, and side effects can last for weeks, you are well aware of it so the player can make the decision not to play.
