Yes I do remember. And so what? The current collective bargaining agreement didn't exist then. If it did, and Jennings wanted to push it, he could have made a strong case like Tapine is making.

Let me put it to you this way then, is the RLPA going to tell the NRL that Mitch Pearce must play cause he is in the top 17?

The RLPA doesn't tell the NRL what to do. The NRL and RLPA negotiated a collective bargaining agreement under which working conditions for players are regulated. It was a mutual agreement of terms.

If there are no other contractual requirements that prevent Pearce from being selected, like disciplinary breaches, and he is fit and considered to be one of the best 17 players, then yes the collective bargaining agreement that recently came into affect would legally require him to be selected.
 
If Tapine has been told to train by himself etc, that's pretty average and I would have thought he'd have something to whinge about. I get the impression that's not really the case... If he's asked for a release now, surely the Knights are in their rights to negotiate his release so that their club isn't disadvantaged.

Tapine knows... his manager knows... the Knight know... the NRL knows... everyone knows, that Tapine is going to be released from the Knights now. The managers just trying to puff his chest out and push his wait around to get what he wants. The Knights are simply sticking to their guns and staring him down. Go Knights!!!

Yet as you said it is not in "black and white". So when it gets to court it is not something that Tapine's crew can use to ensure he does not end up playing NSW all year, hell Brown could tell him he is playing for a "real NRL" team and if he wants his pay check he would have to do it.

Joseph Tapine has broken his silence on his contractual saga, claiming Newcastle "turned their back on me" after he took up a rich deal to join Canberra next season.

Tapine is taking legal action against the Knights after the club banished him from team training, overlooked him for the weekend trial against the Raiders and excluded him from the team photograph.

If Newcastle refuse to release him to the nation's capital on Monday, he will become the first NRL player in history to rescind a contract based on the repudiation of said contract by his employer.

The drama began when Tapine knocked back a $1.1 million Knights extension in favour of one worth up to $2 million, the value of his Canberra deal if the option for a fourth year is triggered.

Having missed out on their man, the Knights then floated a bizarre player swap that involved shifting Tapine to the Roosters in return for a player of their own.

However, Tapine has no intention of playing for three clubs in the space of eight months and wants only to join Canberra after being told he would be in Newcastle's NSW Cup squad.

The drama threatens to overshadow Newcastle coach Nathan Brown's return to the NRL ranks and will likely make off-contract players wary about shifting to the Hunter.

"I hold Nathan in great respect, which is why I'm so disappointed," Tapine said.

"I've done everything I've been asked of me by the club and trained as hard as I could.

"I was really looking forward to being part of the team this year and adding to my 20 first-grade games and developing my career.

"I love Newcastle but, as Nathan himself told me, I had to take the Canberra offer because it was too good to turn my back on.

"Nathan told me to take it and said if it was his son, he would have told him to take it too.

"That's why I thought I had his support moving forward with my career.

"To then be told to train alone, to leave the team environment and be told you're never going to be picked again because of what I've done, I couldn't believe what I was hearing.

"It just makes me feel confused.

"I tried to do everything right, when I was talking to Canberra I kept Newcastle in the loop all the way through the process.

"I didn't break any rules in taking the Canberra offer, I was all geared up to play for Newcastle but then they have turned their back on me.

"It's a pity Nathan has put him and myself in this position because neither of us deserves to be in it."

Tapine's manager, Jim Banaghan, said his client was left with no choice but to take the legal route.

"Newcastle have been given until Monday to allow common sense to prevail," he said.

"It's very unfortunate because the kid loves the club, but you can't be shown the door and forced to train alone in a team sport.

"Newcastle have dug a hole that big for themselves that Nathan Tinkler would have got himself a mining license for it."

Just play cup for a year and move on, suck it up and for eight months think about how prematurely you signed the contract. What he should have done was play his heart out this season for the Knights and come July start thinking of 2017. Loyalty is dead I'm afraid and the nrl need to fix the whole contract mess.
 
I'd much rather them make a stand on something useful, rather than p*ssing into the wind like they are now. They don't have a legal leg to stand on and they're damaging their ability to recruit players in the future. All over a player nearly everyone is telling me isn't in the top 17. Ridiculous.
Do you really think they do this without talking to they're lawyers , if the knights lawyers are telling them Tapine has,nt got a leg to stand on what are they supposed to do ...

You're missing the point. The collective bargaining agreement isn't you have to pick SOO players. It is you have to pick it's best 17 healthy players.

Lets say you're right. Tapine isn't in the top 17. Why then make a fuss? If he's no good at the Knights he isn't going to be any good anywhere else. If he isn't a part of the Knights plans why make such a fuss?
Because he could be that good but the Knights would rather use they're resources on another player , one that's going to be here longer term ...its understandable ...and we all know he wont put in 100% because of the huge contract he has signed at Canberra . That's human nature really.
 
It's not a matter of us just releasing him, we have to pay him out or pay his salary this season why he plays for Canberra. If it was a matter of washing our hands clean and him moving I dare say he would have been in a green jersey last night. Reality is raiders don't have the cap this year to fit him under.
 
Even if worst case Happens and the judge says he stays then pick him on the bench for a couple of games and then tell him he isnt training hard enough and drop him ...

By the time it gets to that point the 2016 season is over and Tapine is happy down in Canberra.

Either way, it's very hard to prove he's being punished. His attitude has changed and he's committed to (and wanting to) be in Canberra. The Knights are in their rights to negotiate his release so that their organisation is not disadvantaged by him leaving. If he wants to leave, he has to concede it won't necessary be on his terms.

Punish him like what? Keeping him out of the team photo and excluding him from training? Where is the evidence that backs these claims up? Tapine and his manager have said that the Knights have turned their back on him and the Knights or Gidley more so stated that Tapine has chosen to train alone on his own accord. No party can be well justified in this situation so I don't see why you're so defensive over the club waiting it out in order to meet a fair arrangement with the release. If we stood by him during his court case and he was all "I want to repay the club" why would he then put himself in an awkward situation by signing a deal with another club a year in advance before a ball is kicked? Yeah, great money no doubt, stupid timing however. This is why player negotiations with the NRL are becoming ridiculous. There should be a specific period at the conclusion of each season as to when a player is able to negotiate with rival clubs. However, contracts in today's game are just becoming a signature of a piece of paper and not an actual binding agreement to fulfil the terms of the deal. If Tapine were to sign with Canberra once this season had concluded then sure that's fair play, an uproar with the fan base would no doubt erupt, but would it really be as much of a mess as it is now? Highly unlikely. He doesn't want to play for us, why should he deserve a spot over someone who does despite whether or not he'd be on more money had he agreed to a new deal here? It'd be unfair in any form if a player was under-performing and being kept in the team over someone being consistently good a grade below and earning less.
 
Maybe I am missing something, but Tapine is contracted to play rugby league for the Newcastle Knights in 2016! Unless there is a clause in his contract stipulating that he will be picked in first grade every week, which I am sure there won't be. As long as he is representing the Knights in some capacity then I can't understand how the contract is breached???

DISGRUNTLED Newcastle backrower Joseph Tapine will be released to the Canberra Raiders as early as Monday after a fortnight of controversy surrounding his future.

Tapine has signed a $2 million four year deal with the Raiders from 2017 but sought an early release after being told by Knights coach Nathan Brown he would not play in the NRL this season with Newcastle because of his decision.

Brown views Tapine as a developing player and was not prepared to continue developing him only to lose him at the end of the season.

The stand-off between player and club turned ugly when Tapine’s manager Jim Banaghan accused the Knights of alienating and exiling him from team training and late last week, threatened the club with legal action to resolve the matter.

Tapine travelled with the Knights NSW Cup squad to Sydney on Sunday for a trial against the Mounties but it is understood he did not attend the match.

He is said to have enjoyed a farewell drink with teammates on Sunday night.

Following Tapine’s decision to sign with the Raiders, the Knights initially investigated a player swap deal with the Sydney Roosters but it was knocked on the head after the former Junior Kiwi international told the club he only wanted to go to Canberra.

Negotiations with the Raiders for a player swap or compensation for releasing Tapine early were also unsuccessful.

Knights CEO Matt Gidley said late last week the club had done nothing wrong and was entitled to investigate all its options involving Tapine before making a decision on his future.

It is understood all the options have been exhausted with the club now prepared to cut its losses and let him go.

Releasing Tapine four months into his contract will give the club around $85,000 to spend on this year’s cap.

So that equals a tiny bit more for a possible outside back or an $85K upgrade for someone to front end their contract a little
